Plaintiff Says Lubbock Officers Should Not Get Immunity

The plaintiff in a taser lawsuit against the City of Lubbock says the three officers involved should not be let off the hook in his case.

Bacilio "Ben" Martinez is suing the city and three police officers in connection with a tasing from a traffic stop in April of 2006.

In court documents filed Tuesday, Martinez claims the officers each violated his constitutional rights of search and seizure and he says they used excessive force.  He also argues they should not be able to claim immunity as a peace officer.
