U.S. Federal Judge Sam Cummings has filed an order granting the government's motion to dismiss the indictment of Gustavo Perales.
Texas Department of Public Safety Troopers arrested Perales, 41, following a traffic stop at Upland and the Brownfield Highway. Perales' rig was missing a mudflap.
Later that month, a federal grand jury indicted Perales for possession with the intent to distribute 1000kg or more of marijuana. However, Perales claimed he had no knowledge of the 2,000 pounds of drugs found in his tractor trailer. The drugs were valued at $1.6 million.
On June 1, 2007, the U.S. Government allowed Perales to take a polygraph test, and the results determined that Perales was telling the truth.
