Part of the lawsuit against the City of Lubbock in connection with a fatal tasing has been dismissed.
On April 16, 2006, Officer Matt Doherty responded to a domestic dispute in the 4400 Block of Jarvis. Doherty tased Juan Nunez III, who died a short time later. An autopsy showed he died as a result of the tasing, a fall and intoxication.
His family had argued that the officer used excessive force and was deliberately indifferent. The judge has now ruled that Doherty was not deliberately indifferent and has dropped that portion of the lawsuit. The portion of the lawsuit that claims excessive force is still active.
