Judge Rules Strip Club Fee Unconstitutional


An Austin judge says Texas may not collect a $5 per customer fee at strip clubs.

That fee went into effect January 1st.  It was expected to raise $44-million for sexual assault prevention programs and health care for the uninsured.

The Texas Entertainment Association and an Amarillo club owner sued. Lawyers for the state argued the legislature was within it rights.

Austin Judge Scott Jenkins says the fee violates the first amendment. The state can appeal.
