He was serving a two-year sentence for deadly conduct, but will now be tried for murder.
A Lubbock County grand jury indicted 27-year-old Jason Lee Bailey Tuesday for the murder of his cell mate.
Officials at the Montford Unit found 48-year-old Richard Barraza unresponsive on December 8, 2007. He had been severely beaten, and died at University Medical Center.
Authorities say Bailey hit Barraza - knocking him unconscious. He then allegedly continued to beat Barraza with either his foot or his knee - crushing the bones in his face.
Authorities say this was not the first time Bailey fought with a cell mate, but say he'd never attacked one before.
