A man shot by a Lubbock County Sheriff's Deputy last month may soon stand trial.
A Lubbock County Grand Jury indicted 47-year-old Van Simkins Tuesday for aggravated assault.
Sheriff's deputies went to a home near County Road 7220 and Avenue P just before midnight March 14th. Authorities say Simkins came out of the home with a rifle and fired it in the air. He went inside, but then came back out and pointed the gun at a deputy. That is when a deputy shot Simkins. He was then taken to UMC.
The deputy was put on administrative leave during the investigation.
