Rosendo Rodriguez Appeal Eligibility Runs Out

In his most recent appeal, time has run out for convicted capital murderer, Rosendo Rodriguez.

Rodriguez's motion for a new trial expired 75 days after he was sentenced to death for the capital murder of Summer Baldwin and her unborn baby.

At a hearing last week, Rodriguez's current attorney tried to prove his original attorney was ineffective. Judge Jim Bob Darnell never ruled on the appeal, allowing the time run out. 

Now Rodriguez's only hope for an appeal is on the federal level.
