The wife of the former New Deal Police Chief testified Wednesday that she picked up her husband's prescription not him.
Pharmacy records show that as well.
The defense says this is important because Sam Butler is accused of lying under oath about an accident in April of 2005.
Prosecutors say Butler was in Lubbock to fill a prescription and not on duty.
He says he was following a suspected drug dealer when a red light runner hit him - which means the accident would be covered by New Deal's Insurance Policy.
Also Wednesday, the defense motioned for an instructed verdict due to insufficient evidence. Judge Cecil Puryear denied that motion.
The trial is expected to wrap up Thursday.
