On Tuesday, a grand jury chose not to indict three aggravated assault cases when the victim did not show up to testify. Now the victim, Lubbock City Councilman John Leonard, speaks out.
A police report says the suspects assaulted Leonard at his then southwest Lubbock apartment at the end of December. He says they left him with broken facial bones and a broken nose.
This is the letter Leonard received from the Lubbock County District Attorney's Office. You can see it asks him to testify on February 19th, not the 10th. In a statement to NewsChannel 11 Leonard says, "Reports of this incident in the media and quotes from the DA's Office have been misleading by making it appear that I was lackadaisical about my obligation to appear before the Grand Jury. Nothing could be further from the truth."
District Attorney Matt Powell told NewsChannel 11 there was a typo in the letter and Leonard will be given the opportunity to speak to the grand jury later this month.
