LUBBOCK, TX (KCBD) - Tuesday evening a Lubbock County Grand Jury decided for a second time to no bill the suspects accused of aggravated assault against a Lubbock City Councilman. Jury members heard this case back on February 10th, but Tuesday was the first time they heard from Councilman John Leonard.
Leonard says three men assaulted him back in December at his then apartment in southwest Lubbock. Leonard says he suffered a broken nose and broken facial bones. When the case first went to grand jury, members chose to "no bill" the three suspects.
Leonard did not testify then, because he says a letter from the Lubbock County District Attorney's Office had the wrong date for when he was supposed to appear. District Attorney Matt Powell told NewsChannel 11 there was a miscommunication and allowed Leonard to testify Tuesday.
There were only two suspects listed in the matter of the assault on Tuesday. The D.A.'s office tells us that's because they could not determine exactly who the third suspect was or what he may have done. Again, the remaining two suspects were not indicted for the assault.
