Settlement reached with 26 plaintiffs in deadly Midland train accident
MIDLAND, TX (KCBD) - Eight families involved in a lawsuit in a deadly Midland train crash have agreed to a settlement with Union Pacific Railroad.
Four veterans were killed when a train crashed into a parade float back in 2012.
After two years in litigation, 26 of the 43 plaintiffs have entered into a confidential settlement.
Trial is set to begin on Jan. 26 in the 441st District Court in Midland County, Texas. Judge James Rush is hearing the case after Judge Satterwhite recused himself.

Bob Pottroff of Manhattan, Kansas and the Kevin Glasheen of Glasheen, Valles & Inderman jointly represent eight families involved in the fatal accident in which a freight train struck a parade float in Midland, Texas on November 15, 2012. The parade was travelling south on Garfield, crossing the Union Pacific tracks near Front Street. There were four fatalities and multiple serious injuries. Pottroff and Glasheen represent 26 of the 43 Plaintiffs in the lawsuit. The Plaintiffs claimed that there was a defect in the signal system, causing a delayed activation of the lights and gates.
The case has been in litigation for over two years, and is set for trial on January 26th, 2015 in the 441st District Court in Midland County, Texas. Judge James Rush is hearing the case after Judge Satterwhite recused himself.
After over two years of litigating the case, the 26 Plaintiffs represented by Pottroff and Glasheen have entered into a confidential settlement with Union Pacific Railroad. The remaining Plaintiffs are scheduled to begin trial in Midland, Texas on January 26, 2015. All Plaintiffs have previously settled with the truck driver Dale Hayden; the parade organizers, Show of Support; and Smith Industries, who owned the tractor trailer being used as a parade float. Plaintiffs contended that the short warning from the lights and gates was the principal cause of the wreck.
Pottroff and Glasheen's clients who have settled include the family of Joshua Michael, who was killed in the wreck; Meg Ladner, who lost her leg; and Richard Sanchez, who was left with partial paraplegia from the wreck. A complete list of Pottroff and Glasheen's clients is set forth below.
The remaining Plaintiffs are represented by Steve Malouf of Dallas, Charla Aldous of Dallas, Jack Hill of West Palm Beach, Florida, and Jim Mitchell of Dallas. Pottroff and Glasheen would not comment on why their clients' claims were settled and the other Plaintiffs claims were not settled.
Kevin Glasheen said: "We cannot comment on the settlement amounts other than to say that our clients are very satisfied with the results. The settlement gives them the security and comfort they will need while they try to rebuild their lives. They were treated very well."
