LUBBOCK, TX (KCBD) - A Slaton man will spend 40 years behind bars after a Lubbock County jury found him guilty of aggravated assault with a deadly weapon.

Police say 47-year-old Danny Whaley poured gasoline on his wife and threatened to light her on fire.

Whaley would have faced a minimum amount of 25 years in jail, but the jurors unanimously settled on a more severe punishment around 3 p.m. Wednesday.

In the warrant, on September 18, 2014, 47-year-old Whaley grabbed the woman's hand and then assaulted her. The attorney representing this woman said her children were in the bed at the time and witnessed the crime.

This comes after Whaley's previous convictions of domestic violence, assault on a public servant and aggravated assault with a deadly weapon.
